Sūrah Al-Mursalāt The Emissaries

المرسلات

Al-Qurṭubī derives from this surah's repeated condemnation of deniers the fiqh rulings on the pork prohibition its scope, the treatment of derivatives, and the necessity exception across all four schools.

DetailInformationClassificationSignificance
SurahAl-MursalātMeccanCosmic oaths and warnings to those who deny divine truth
Key Fiqh IssuePork prohibition scope, derivatives, and necessity exceptionḤarām by definitive naṣṣOne of the most clearly established dietary prohibitions
School ComparisonAll four schools: pork ḥarām unanimously; Ḥanafī: pork fat ḥarām; derivatives assessed individually; Mālikī/Shāfiʿī: whole pig ḥarām, derivatives ḥarām; Ḥanbalī: istibḥāl (complete transformation) debate for derivativesḤarām / Necessity exceptionNecessity can permit pork in life-threatening situations
Uṣūl PrincipleNaṣṣ qāṭiʿ definitive prohibition text requiring no ijtihād on the base ruleAbsolute prohibitionThe base prohibition is beyond scholarly dispute; derivative questions require ijtihād

Al-Qurṭubī derives from this surah's context repeated warnings to those who deny truth the connection between ḥalāl/ḥarām compliance and divine submission. He uses the surah as an occasion to survey the pork prohibition: the base ruling (pork ḥarām) is naṣṣ qāṭiʿ (definitive text) established in Al-Baqarah 2:173, Al-Māʾidah 5:3, Al-Anʿām 6:145, and Al-Naḥl 16:115 four Qurʾānic prohibitions leaving no room for ijtihād on the base case.

The school debates concern derivatives: is pork-derived gelatin ḥarām? Is pig fat ḥarām? The Ḥanbalī school's istibḥāl (complete transformation) debate is most significant: if a prohibited substance undergoes complete chemical transformation into something different in nature (like pig bones processed into ash used in fertilizer), some scholars argue the prohibition no longer applies. The modern application of this debate to food industry questions (gelatin, enzymes, emulsifiers) shows the ongoing legal relevance of this classical discussion.

وَيْلٌ يَوْمَئِذٍ لِّلْمُكَذِّبِينَ Waylun yawmaʾidhin li-l-mukadhdhibīn Meaning: "Woe that day to the deniers" Al-Qurṭubī: while this verse addresses theological denial, al-Qurṭubī connects it to the broader pattern of divine commands: denying the validity of ḥalāl/ḥarām distinctions that Allah has established is a form of takdhīb (denial); consuming the clearly prohibited while rejecting the prohibition is not merely a dietary lapse but a form of religious defiance.
أَلَمْ نُهْلِكِ الْأَوَّلِينَ Alam nuhliki l-awwalīn Meaning: "Did We not destroy the former peoples?" Al-Qurṭubī: divine destruction of previous nations is linked to their rejection of divine commands including dietary and legal commands; the pork prohibition is one expression of submission to divine authority that the destroyed nations rejected in various forms.
  • Pork prohibition is naṣṣ qāṭiʿ established by four Qurʾānic verses and unanimous scholarly consensus; no ijtihād is possible on the base ruling.
  • Pork fat, blood, and all clearly pig-derived products are ḥarām the whole animal is prohibited along with its clearly derived parts.
  • Istibḥāl (complete transformation) debate: if a prohibited substance undergoes total chemical transformation, the resulting substance may no longer carry the prohibition active scholarly debate, especially for derivatives.
  • Necessity exception: a person facing death from starvation with no ḥalāl food available may consume the minimum amount of pork needed to survive ḍarūrah (necessity) is a universal exception to dietary prohibitions.
  • Necessity must be genuine and proportional only the minimum amount required for survival is permitted; eating beyond the survival threshold reactivates the prohibition even under necessity conditions.
